The terms for Byrne Waste Tracking.

01Who we are

This service is provided by Wilf Byrne, trading as Byrne Digital Solutions (a sole trader), of 1 Kings Avenue, Newcastle-under-Lyme, ST5 8DA. In these terms, "we", "us" and "our" mean Wilf Byrne, trading as Byrne Digital Solutions, and "you" means the business using the service.

We are an independent supplier. We are not affiliated with, endorsed by, or acting on behalf of DEFRA, the Environment Agency, SEPA, NRW or DAERA.

02What the service does

Byrne Waste Tracking helps you record waste received at your permitted site and produce a completed copy of DEFRA's Receipt of Waste spreadsheet template.

What it does:

  • Records waste movements and waste items against your site and permit
  • Tracks the two-working-day reporting window on each load
  • Fills in DEFRA's own spreadsheet template with your data, for you to upload, and — once you link your DEFRA account — can send your loads to DEFRA for you

What it does not do:

  • Until you link your DEFRA account, it does not submit anything to DEFRA — you upload the spreadsheet yourself. Once linked, it sends on your instruction; you remain responsible for what is sent and for checking it arrived.
  • It does not decide whether a movement is reportable, or whether your site is in scope.
  • It is not legal, regulatory or compliance advice.

03Your account

You must give accurate site details, including your permit number. You are responsible for keeping your login secure and for anything done under your account. Tell us promptly if you think it has been compromised.

04Fees and cancellation

  • £89 per month per site, or £890 for 12 months. Both include unlimited loads and users. Prices exclude VAT because we are not currently VAT registered.
  • Online signup has no setup fee. A £70 one-off setup fee applies only when the service is sold by phone or through a reseller. That price is stated before payment.
  • Monthly charges start on 1 November 2026. A 12-month plan is charged when it is bought.
  • We don't add a charge to a price somebody was already given, or bring one forward.
  • Customisation is charged separately: £60 for a standard piece of work. Where a job is larger than standard we will tell you the price before starting it, never afterwards.
  • Billed monthly in advance. No minimum term.
  • You may cancel at any time, effective at the end of your current paid month. Cancelling is no harder than signing up — email wilf@byrnedigitalsolutions.co.uk.
  • We will give at least 30 days' notice by email before any price change. If you don't accept it, you may cancel before it takes effect.
  • Fees already paid are not refunded on cancellation, except where required by law or where clause 8.4 applies.

05Your compliance remains yours — please read this

You are the operator. Legal responsibility for reporting your waste receipts to DEFRA rests with you and cannot be transferred to us. DEFRA's own guidance is explicit that the permit holder remains responsible for ensuring data is submitted.

Specifically, you remain responsible for:

  • deciding whether your site is in scope and which movements are reportable
  • the accuracy of everything entered into the service
  • checking each generated spreadsheet before you upload it
  • getting each load to DEFRA within the statutory deadline — by uploading the spreadsheet, or by checking that automatic sending has worked
  • registering with DEFRA and paying their annual charge

We provide a tool. We do not provide compliance.

06Availability

We aim to keep the service available but do not guarantee uninterrupted access. We may carry out maintenance, and will give notice where reasonably practicable.

You should keep your own records. You can download a spreadsheet of every load you have recorded at any time, and DEFRA's own spreadsheet of any loads not yet sent. We recommend you keep a copy regularly.

07Your data

  • Your waste movement records remain yours. We claim no ownership of them.
  • We process them only to provide the service — see the Data Processing Agreement, which forms part of these terms. Email wilf@byrnedigitalsolutions.co.uk and we will send you a copy.
  • Data is held in the United Kingdom.
  • When your account closes, you can ask us for a spreadsheet of all your data. It stays readable for 30 days after your account closes, and we delete it within 90 days of closing, unless you ask us to delete it sooner.

08Limitation of liability

8.1 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.

8.2 Subject to 8.1, we are not liable for: regulatory fines, penalties or enforcement action taken against you; loss of profit, revenue, business or goodwill; or any indirect or consequential loss.

8.3 Subject to 8.1, our total liability to you in any twelve-month period will not exceed the fees you paid us in that period.

8.4 If the service is unavailable or defective such that you cannot produce a return, your remedy is a refund of fees for the affected period.

8.5 These limits are reasonable given the fee charged and the fact that you retain legal responsibility for your own compliance under clause 5.

09Ending the agreement

You may end this agreement at any time, as set out in clause 4. We may end it on 30 days' notice by email, or suspend or end it immediately if fees go unpaid or the service is used unlawfully.

10Changes

We may update these terms and will give at least 30 days' notice by email of anything material. Continuing to use the service after that means you accept the change.

11General

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If any clause is unenforceable, the rest stands.
